Ohio's recent legalization of marijuana has opened up a lucrative market for entrepreneurs and investors looking to capitalize on the growing industry. Ohio is expected to see significant tax revenue from the legalization of recreational marijuana. A report by the Ohio State University Drug Enforcement and Policy Center estimates that Ohio could receive an additional $276 million to $404 million in annual tax revenues from legal marijuana in the fifth year after legalization. The new marijuana reform law passed by Ohio voters in November 2023 establishes a special 10% tax on the sale of adult-use cannabis, in addition to the traditional 5.75% state sales tax and up to 2.25% local sales taxes [[2]]. The revenue from this 10% special marijuana tax will be allocated to several funds:


- 36% will go to a "Cannabis social equity and jobs program" to fund activities like education, technical assistance, and investment in disproportionately impacted communities. [[2]])



-25% will support the efforts of the Department of Mental Health and Addiction Services to address substance abuse and addiction. [[2]]


- 3% will go towards the operations of the Division of Cannabis Control and the Department of Taxation [[2]]


- The remaining 36% will be distributed to municipal corporations and townships that have adult-use dispensaries [[2]](



Compared to other states that have legalized marijuana, Ohio's proposed 15.75% total tax rate (10% special tax + 5.75% state sales tax) is slightly below the average and median tax rates imposed by other legal states, which range from 6.625% in New Jersey to 43.5% in Washington. [[2]]


However, Ohio's rate is nearly identical to the 16% tax in the neighboring state of Michigan. [[2]]


While the tax revenue projections are significant, some lawmakers like Senator Mark Romanchuk have expressed concerns about the potential societal costs of legalization, such as increased black market activity and public health impacts. [[3]]


However, proponents argue that the tax rate and regulated market will help drive consumers away from the illicit market. [[3]]


Overall, the search results indicate that Ohio stands to generate hundreds of millions in annual tax revenue from the legalization of recreational marijuana, with the funds being allocated to support social equity, addiction services, and local communities.
